MCMS CEO Statement on the Multiplan Lawsuit: Protecting Fair Reimbusement, Physician Sustainability, and Patient Access to Care

The Maricopa County Medical Society (MCMS) welcomes increased scrutiny of practices that may undermine fair reimbursement, physician sustainability, and patient access to care. The 83-page lawsuit filed by Attorney General Kris Mayes on June 1, 2026, raises significant concerns regarding the alleged use of centralized pricing algorithms and coordinated reimbursement methodologies that may have artificially suppressed payments for out-of-network medical services across multiple health insurers.

 

If the allegations are substantiated, this case highlights a troubling market dynamic in which physicians and healthcare facilities were deprived of meaningful negotiation opportunities while patients, employers, and providers absorbed the financial consequences. Fair market competition depends upon independent decision-making, transparency, and accountability. Any system that artificially depresses reimbursement rates can threaten the stability of physician practices, particularly independent, rural, behavioral health, and safety-net providers already operating under significant financial pressures.

 

From the physician perspective, reimbursement is not simply a business issue, it is directly tied to maintaining access to care, retaining healthcare professionals, investing in technology, supporting staff, and ensuring patients receive timely services within their communities. Chronic underpayment can force practices to reduce services, delay expansion, limit acceptance of certain insurance products, or, in some cases, close altogether.

 

The allegations are especially concerning given Arizona's ongoing physician workforce shortages. As healthcare costs continue to rise, reimbursement methodologies must appropriately reflect the value, complexity, and cost of delivering care. Sustainable payment structures are essential to preserving a strong healthcare infrastructure and ensuring patients maintain access to physicians across all specialties.

 

Equally important is the impact on patients. Individuals who purchase health insurance expect their coverage to provide financial protection. If reimbursement systems result in excessive cost-shifting to patients through higher out-of-pocket expenses or unexpected medical bills, public trust in the healthcare system is diminished.

 

MCMS supports transparency, fair competition, and reimbursement practices that promote patient access, physician viability, and a sustainable healthcare marketplace. We will continue to monitor this litigation closely and advocate for policies that strengthen
